Consultancy Services to Determine and Establish Emerging Issues from the Application of the Public Procurement and Disposal Act, 2005 and the Regulations, 2006 in Public Procuring Entities

The Public Procurement Oversight Authority (PPOA) intends to engage consultants to undertake research on various issues in public procurement.

BACKGROUND
The Public Procurement System in Kenya has been improved from an unregulated system in the 60's, through a system regulated by Treasury Circulars in the 70's, 80's and 90's and to a legally regulated procurement system since March, 2001 with the establishment of the Exchequer and Audit (Public Procurement) Regulations.

The need to have a sound legal framework and to address the shortcomings of the 2001 procurement regulations resulted in the enactment of the Public Procurement and Disposal Act, 2005 which became operational on the 1st of January, 2007.

The Act created the Public Procurement Oversight Authority (PPOA), mandated among other functions to monitor the procurement system and report on its overall functioning and recommend areas of improvement. To this end, PPOA intends to carry out research on various pertinent issues to further assist in streamlining the Public Procurement and Disposal System in Kenya.

OBJECTIVE OF THE ASSIGNMENT

The main objective of the assignment is to conduct research on various issues of interest as and when they arise in public procurement and disposal and come up with recommendations for further improvement in future.

SCOPE OF SERVICES

PPOA will issue Request for Proposals complete with the relevant terms of reference for each assignment that comes up.

PPOA now invites interested eligible consulting firms to express their interest in this assignment.

Interested eligible consulting firms must meet the following minimum requirements: -

1. Submit a relevant company profile, evidence of registration with the relevant authorities and a valid tax compliance certificate.

2. Interested eligible consulting firms must demonstrate the following which they will be evaluated on: -

(a) Recent experience in research related work preferably but not limited to a value not less than Kshs. 2 million with appropriate references.

(b) Knowledge and understanding of the Public Procurement and Disposal system in Kenya.

(c) Ability to bring together graduate professionals (with evidence of membership to their relevant professional bodies) with not less than five (5) years experience not limited to Economics, Finance, Law, Engineering, Information Technology, Procurement and Logistics.

A short list of qualified firms valid for two (2) years will be prepared thereafter. Short listed firms will be issued with a Request for Proposal (RFP) document with the relevant terms of reference as and when an assignment comes up.

Expression of Interest to Offer Consultancy Service to the Ministry Of Water and Irrigation on Development of Land Reclamation Policy.

1. Background

The Ministry of Water and Irrigation has been implementing Sector reforms following the launch of the National Policy on Water Resources management and development in 1999 and the enactment of the Water Act 2002. The Ministry wishes to deepen these reforms to cover other sub-sectors of the Ministry that were not covered during Water Policy formulation and review.

Consequently the Ministry wishes to hire the services of a consultant or consultancy firm to guide in the process of formulation of a Land Reclamation policy.

2. Objectives

The overall objective of the consultancy is to assist the department complete the Land Reclamation Policy and strategies for the sub-sector.

3. Scope of work
  • Review and align the draft Land reclamation policy document with related policies
  • Develop an action plan to facilitate the finalization of the Land Reclamation policy and strategies
  • Facilitate 3 stakeholders workshops geared towards development of a Land Reclamation policy and strategies.
  • Prepare a refined draft policy document after the stakeholder workshops and present the results in PowerPoint to the steering committee.
  • To advice /assist the steering committee in other related matters
4. Approach

The consultant will be required to review existing relevant documents and make recommendations to a steering committee for the way forward in the formulation of an all inclusive and participatory policy development process.

The Consultant in consultation with the steering committee members will be responsible for drawing up the schedule of activities of the draft policy reviews, and organization of the whole process.

The consultant will more specifically;-
  • Analyze the challenges of land Reclamation on national development
  • Analyze the impact and challenges of implementing the sub- sector plans and recommend institutional framework.
  • Analyze the linkages and likely impact the Land Reclamation Policy may have on other sectors and on the environment
  • Lead in at least 3 stakeholders consultative meetings /workshop
  • Develop, refine and deliver a completed Land Reclamation policy draft document
  • Timing The consultant will be engaged on short term basis on to an agreed action plan for a period not exceeding 40 days.
5. Qualification and experience

The lead Consultant has a minimum of a Masters degree in a relevant field, be knowledgeable on land development and reclamation issues. Must have wide skills and experience in policy formulation, moderation in workshops and meetings. Be experienced in Land Reclamation and ASAL development as it relates to national development.

The expression of interest and availability to undertake the requested service at a short notice should include: a detailed CV of the Key consultants, time allocated, details of previous experience for similar work and a financial proposal. Consultancy Services for Pre-Feasibility Studies for the Development of a Long Term Integrated Bus Rapid Transit (BRT) System for Greater Kampala Metropolitan Area (GKMA)

The World Bank intends to finance the assignment/services described below under a trust fund from the Public Private Infrastructure Advisory Facility (PPIAF).

The services include pre-feasibility studies for the development of a long term integrated conceptual designs for a BRT System for GKMA; identification of priority transport corridors for the BRT system; and selection of one transport corridor on which a detailed engineering and operations design for a pilot BRT should be carried out.

The assignment will also include preparation of the Terms of Reference (TOR) for the detailed engineering and operations design for the pilot BRT system on the selected corridor and definition of institutional reforms and financial controls necessary for operating the system.

Kampala City is the capital and commercial centre of Uganda. Greater Kampala Metropolitan Area (GMKA) covers an area of 970 km.2 with a population of 2.37million people (2005 figures) and is expected to grow to 2.78 million by the year 2010, 3.65 million by the year 2018 and 5.20 million by the year 2030.

The current public transport system in GKMA is characterized by unreliable, unsafe, low capacity second hand mini-buses (14-seater) without scheduled services, dedicated routes, predictable fare regime and with high levels of emissions. Traffic congestion resulting from the high number of low-capacity public transport vehicles and increasing private car use are a major problem in GKMA.

The Government of Uganda and Kampala City Council (KCC) have a long term vision of providing affordable mobility and improving the quality of life of the urban population, and have identified BRT as the main component of this vision. The envisioned BRT system should be reliable, environmentally sustainable, operate on specialized infrastructure and be commercially viable.

The scope of this assignment calls for knowledge and experience in BRT systems design and implementation hence competencies in: urban transport modeling; traffic engineering, architectural design; mass transit operations design; design of BRT technical components (such as fare collection and advanced transit control systems) and Traffic Management Measures.

Other competencies include ability to carry out financial and commercial investment appraisal; social and environmental impact analysis; review of institutional and regulatory regime and socio-economic assessment. The estimated implementation period is four (4) months and the approximate amount for this assignment is US$ 279,000.

The World Bank now invites eligible consultants to indicate their interest in providing the services. Interested consultants must provide information indicating that they are qualified to perform the services (brochures, description of similar assignments, experience in similar conditions, availability of appropriate skills among staff, etc.). Provision of Consultancy Services for Developing a New Strategic Corporate Plan.
2009/10 - 2012/13

National Housing Corporation (NHC) is a State Corporation established under the Housing Act (Cap 117). The Corporation has been implementing a five year Strategic Corporate Plan which comes to an end in June 2009.

In view of this, NHC wishes to develop a new Corporate Strategic Plan for the period 2009/10 - 2012/13 in line with the Kenya Vision 2030, first Medium Term Plan (2008
- 2012), National Housing Policy For Kenya and other National development policy documents.

The Corporation invites Kenyan registered Consultant firms/Consortium of Consultant firms with relevant qualification and experience to submit Technical and Financial proposals to undertake this exercise.

In preparing the Corporation's Corporate Strategic Plan, the following critical areas will need to be addressed by the consultant: -

i. Analyze the Corporation's mandate and core functions and align them to the Vision 2030 and the Medium Term Plan (2008 - 2012).

ii. Undertake a situational analysis of the Corporation, paying attention to Vision, Mission, and Core Values as outlined in the NHC Strategic Plan 2005 - 2009 and recommend areas of improvement and adjustments,

iii. Analyze and review the strategic objectives, strategies, activities and outcomes as outlined in the implementation matrix of the 2005 - 2009 Strategic Plan and suggest necessary changes or/and modifications,

iv. Undertake a comprehensive analysis of all stakeholders of the NHC and prioritize the critical ones relevant to the Corporation,

v. Develop a Balanced Score Card to translate the Corporations' Vision and strategy into a comprehensive set of performance measures that will provide a framework for the strategic measurement system,

vi. Develop a framework for NHC's strategic planning process ensuring timely completion and thereby enabling the Corporation derive maximum benefit from the process,

vii. Facilitate the strategic planning process and produce a new draft and acceptable Corporate Strategic Plan covering the period 2009/10 - 2012/13 consistent with priorities outlined in the Medium Term Plan 2008 - 2012 of Kenya Vision 2030.

Kenya Investment Authority (Kenlnvest) is a statutory organization established by an Act of Parliament, the Investment Promotion Act, No. 6 of 2004. It is charged with the responsibility of promoting and facilitating investments and providing necessary assistance to both local and foreign investors.

Kenlnvest intends to commission consultants/consultancy firms to develop a policy framework for investment in the flagship sectors that have been given priority as key growth drivers in Vision 2030, namely:

The process will entail: A sector/sub-sector situational analysis; An analysis of the policy framework for investment in the sectors, covering laws and regulations, and various policy initiatives undertaken previously; Identifying impediments to investment in the sectors and recommending appropriate reform measures to improve investment in the sectors; Carrying out an assessment of current incentives available and proposing a new regime of national, regional and/or sectoral incentive structure; Identifying succesful models used in other countries, to be used as benchmarks; Identifying the roles of key stakeholders who interface with investors in their day to day operations; Carrying out comprehensive consultations with key stakeholders to collect information/data in refining the expected output; Aligning the proposed policy measures with other regional cooperation initiatives, to avoid inconsistency; Formulating a strategy for joint investment promotion campaigns by key stakeholders; Identifying key institutions dealing with each sector/sub-sector; Preparing an implementation schedule for identified reform measures.

Qualifying research consultants are required to present a detailed proposal for the above tasks indicating technical and financial capacities, together with profiled experience in similar assignments. The Nile Basin Initiative has received financing from the World Bank toward the cost of the Nile Basin Initiative - Institutional Strengthening Project 'NBI-ISP), and intends to apply part of the proceeds for consultant services to carry out an Institutional Design Study (IDS) leading to the identification and clarification of institutional arrangements for the NBI.

Background
The Nile Basin Initiative (NBI) has received grant funding for implementing the NBI Institutional Strengthening Project (NBI-ISP). The ISP is meant to strengthen the institutional capacity of NBI Secretariat, Eastern Nile Technical Regional Office (ENTRO) and Nile Equatorial Lakes Subsidiary Action Program Coordination Unit (NELSAP-CU).

Specifically, the ISP will support NBI to promote the integrated development and strengthening of the Nile Basin Initiative (NBI) institutions, prepare building blocks for a future river basin organization, harmonize on-going institutional strengthening and capacity building activities within the NBI, and ensure that outcomes of completing projects are properly captured.

In order to identify and clarify options for the NBI Institutions, the NBI is seeking an experienced firm to review the current institutional structure, assess future needs, and identify comparable regional models. Based on that review, the consultant will provide the NBI with suggested options for improving and streamlining institutional and governance structures.

The ISP Institutional Design Study Objectives:
  • To identify and critically examine strengths and weaknesses associated with the current institutional arrangements of NBI, including governance arrangements and procedures;
  • To identify future needs of the NBI as it transitions from an interim institution to a permanent river basin organization;
  • To identify and compare similar regional organizations for use as design models for the NBI;
  • To identify synergies and partnership opportunities among other regional organizations operating in the Nile basin;
  • To propose a series of potential institutional design options (including costs) for consideration by NBI stakeholders and decision makers; and
  • To facilitate an informed discussion among stakeholders and decision makers in the Nile Basin countries as they consider the path forward in Nile Basin cooperation.
The Institutional Design Study will be delivered in two phases:

1. Phase 1 (approximately 12 months) will comprise a review of current arrangements, assessment of future needs, and comparison with similar regional organizations. The results should include an initial set of illustrative options for: a. Institutional architecture and governance arrangements for the NBI: and b. Enhanced synergies and collaboration with other regional institutions operating in the Nile Basin.

2. Phase 2 (approximately 6 months) will comprise intense, facilitated dialogue with key NBI stakeholders on the proposed options. The outcome will be a report that focuses on a few (probably three or less) options that will be presented to the Nile Council of Ministers of Water (Nile-COM) at a facilitated wrap-up seminar.

Invitation to Tender for Consulting Services: SIDA

The Ministry of Lands in Kenya wishes to procure consulting services of two Technical Assistants (TAs) to its land reform programme. Charles Kendall & Partners Ltd acting for and on behalf of the Swedish International Development Cooperation Agency (Sida), Nairobi and the Ministry is calling for tenders from Corporate Service Providers to provide the services to support the Ministry's Land Reform Transformation Unit, (LRTU) based at the Ministry headquarters in Nairobi.

The requirement is for the provision of two Technical Assistants as follows:

Lot 1 - Technical Assistance - Support for the Land Reform Transformation Unit (LRTU)
The main objective of the LRTU Technical Assistance is to provide technical support to the Ministry of Lands/LRTU as it implements the Land Reform Support Programme (LRSP), i.e. realises and implements activities and programmes therein which are in line with the framework of the land policy process in Kenya.

Lot 2 - Technical Assistance - Strategic Land Information Management Systems (LIMS).
The main objective of the strategic LIMS Technical Assistance is to provide strategic and programme level support to the development and implementation of a LIMS, an ongoing programme that has been conceptualised in the land policy framework with adherent LIMS reports.

The successful applicants will be employed on a full time basis and the will be contracted by Sida on behalf of the Ministry for a period of 2 years.

Development of a 5 (five) years strategic plan (2009 - 2013) Tender Notice: Brand Kenya Board

Kenya Board wishes to invite tenders for Development of a 5 (five) years strategic plan (2009 - 2013).

The strategic plan is meant to guide the Board in its key roles and responsibilities of developing a country image and identity and also enhancing Kenya's International image.

Terms of Reference for the development of the 5 years strategic plan may be purchased by interested bidders from the offices of the Brand Kenya Board, Telposta Towers, 28th, floor (Uhuru Highway entrance) at a non-refundable fee of Ksh. 2000 (Two thousand only) either in bankers cheque or cash, payable to the Ministry of Information and Communications cash office on 8th Floor of Telposta Towers (Koinange Street entrance) and be returned and deposited in the tender box situated outside the Brand Kenya offices on or before 12 O'clock, Thursday 22nd January 2009.

Prices quoted will remain valid for a period of 3 (three) calendar months from the date of opening the tender.
