Request for Expressions of Interest

Consultancy Services to Determine and Establish Emerging Issues from the Application of the Public Procurement and Disposal Act, 2005 and the Regulations, 2006 in Public Procuring Entities

The Public Procurement Oversight Authority (PPOA) intends to engage consultants to undertake research on various issues in public procurement.

BACKGROUND
The Public Procurement System in Kenya has been improved from an unregulated system in the 60's, through a system regulated by Treasury Circulars in the 70's, 80's and 90's and to a legally regulated procurement system since March, 2001 with the establishment of the Exchequer and Audit (Public Procurement) Regulations.

The need to have a sound legal framework and to address the shortcomings of the 2001 procurement regulations resulted in the enactment of the Public Procurement and Disposal Act, 2005 which became operational on the 1st of January, 2007.

The Act created the Public Procurement Oversight Authority (PPOA), mandated among other functions to monitor the procurement system and report on its overall functioning and recommend areas of improvement. To this end, PPOA intends to carry out research on various pertinent issues to further assist in streamlining the Public Procurement and Disposal System in Kenya.

OBJECTIVE OF THE ASSIGNMENT

The main objective of the assignment is to conduct research on various issues of interest as and when they arise in public procurement and disposal and come up with recommendations for further improvement in future.

SCOPE OF SERVICES

PPOA will issue Request for Proposals complete with the relevant terms of reference for each assignment that comes up.

PPOA now invites interested eligible consulting firms to express their interest in this assignment.

Interested eligible consulting firms must meet the following minimum requirements: -

1. Submit a relevant company profile, evidence of registration with the relevant authorities and a valid tax compliance certificate.

2. Interested eligible consulting firms must demonstrate the following which they will be evaluated on: -

(a) Recent experience in research related work preferably but not limited to a value not less than Kshs. 2 million with appropriate references.

(b) Knowledge and understanding of the Public Procurement and Disposal system in Kenya.

(c) Ability to bring together graduate professionals (with evidence of membership to their relevant professional bodies) with not less than five (5) years experience not limited to Economics, Finance, Law, Engineering, Information Technology, Procurement and Logistics.

A short list of qualified firms valid for two (2) years will be prepared thereafter. Short listed firms will be issued with a Request for Proposal (RFP) document with the relevant terms of reference as and when an assignment comes up.
